Chilli Pool is a brand operated by SPAS Manufacturing Australia Pty Ltd (ABN 60 652 474 998). These terms govern the use of chillipool.com.au (Website). By accessing, using, browsing, registering with, contributing to or purchasing from any area of the Website, you agree that your access to, use of, and purchase of any goods from the Website is subject to these terms and all applicable laws, and is at your own risk. If you do not agree to these terms in their entirety, you must not use this Website.

When purchasing goods from the Website, these Terms and Conditions form a contract between you and Chilli Pool (Chilli Pool, we, us, our) and apply to the ordering, purchase, fulfilment and delivery of goods from the Website. Please read these Terms and Conditions carefully before placing your order as they contain important information, including limitations of liability.

We may amend these terms at any time by posting changes to this Website without notice. By continuing to use the Website, you are deemed to have accepted any changes. These Terms and Conditions, together with our Privacy Policy and Returns Policy, set out the entire agreement between you and Chilli Pool regarding this Website and, to the fullest extent permitted by law, supersede all prior terms, conditions, warranties and representations.

1. Definitions

Chilli Pool Online means chillipool.com.au

Business Day means a weekday on which trading banks are open for business in Melbourne, Australia.

Delivery Address means the address to which goods are to be delivered as stated in your order.

Delivery Agent means any nominated third-party delivery or shipping company engaged by Chilli Pool.

Goods means the items offered for sale on the Website.

GST has the meaning given in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

Order means a request by you to purchase goods from Chilli Pool Online.

Personal Information has the meaning given in the Privacy Act 1988 (Cth).

Price means the purchase price of each good as specified on the Website in Australian dollars, inclusive of GST.

2. Compliance with Terms and Conditions

2.2 Each order you submit is a separate and binding agreement between you and Chilli Pool with respect to the supply of goods in accordance with these Terms and Conditions.

3. Placing Orders

3.1 You may place an order through the Website by submitting the electronic order form.

3.2 An order submitted by you is an offer to purchase goods at the Price plus any applicable delivery fee as specified at the time of submission. That offer cannot be withdrawn without our prior consent.

3.3 All orders through the Website are for goods intended for residential use only, unless otherwise agreed.

3.4 You agree to provide complete and accurate information when placing an order. Chilli Pool is not liable for any delay or failure to process, fulfil or deliver an order due to inaccurate or incomplete information provided by you.

3.5 You may order from Chilli Pool Online if you are aged 18 years or over, have an active email address, and a telephone number at which you can be contacted.

3.6 Check your order carefully before submitting. Once submitted, cancellations or changes may only be made by agreement unless otherwise required by law.

3.7 Separate orders cannot be consolidated. A separate delivery fee will apply to each order.

3.8 You will receive an order confirmation number on submission. Retain this for any customer service enquiries.

3.9 In submitting an order you confirm that you are over 18, have read and agreed to these Terms and Conditions, and have complied with all applicable laws.

4. Acceptance and Rejection of Orders

4.1 Chilli Pool reserves the right to accept or reject any order at any time.

4.2 Acceptance of an order represents an agreement by Chilli Pool to supply the goods in accordance with these Terms and Conditions.

4.3 If we reject an order, we will notify you by email within five (5) Business Days wherever possible. Chilli Pool is not liable for any loss arising from the rejection of an order.

4.4 Where an order is rejected and payment has already been processed, we will refund the amount paid and endeavour to do so within five (5) Business Days. Your receipt of the refund will depend on your financial institution's processing times.

4.5 If we are unable to contact you using the details provided after making reasonable attempts, we will reject the order in accordance with this clause.

5. Availability of Goods

5.1 From time to time, goods may be out of stock or unavailable. If this occurs, we will use reasonable endeavours to contact you within five (5) Business Days to arrange a full or partial refund.

5.2 We reserve the right to withdraw or suspend any good from sale at any time without notice. Chilli Pool is not liable for any loss arising from such withdrawal or suspension.

5.3 Where an order is affected by an error on the Website (including in relation to description, image or price), we may reject the affected part of the order and proceed to fulfil the remainder in accordance with these Terms and Conditions.

5.4 All images on the Website are for illustration purposes only. You confirm that you have read the written product description prior to ordering.

6. Price and Payment

6.1 Prices are displayed in Australian dollars and include GST.

6.2 Chilli Pool reserves the right to change prices at any time without notice, except where you have already submitted an order at a stated price.

6.3 For each order, you agree to pay the price at the time of submission plus any applicable delivery fee.

6.4 Payment methods accepted are as specified on the Website at the time of purchase. When paying by credit card, you authorise Chilli Pool to debit your card upon submission of your order.

6.5 Goods will not be dispatched until payment has been cleared. If your payment cannot be processed, your order will be rejected and you will be notified.

6.6 In making payment, you confirm that you have not engaged in fraudulent conduct or contravened any applicable law.

6.7 You will receive an invoice by email once payment has been processed.

6.8 Chilli Pool uses an encrypted payment gateway. Whilst we take all reasonable precautions, we cannot guarantee the security of any transaction.

7. Delivery

7.1 Chilli Pool uses third-party delivery agents to deliver your goods. You consent to your delivery details being supplied to the relevant delivery agent for this purpose.

7.2 Shipping options and applicable fees are set out in the Shipping Policy on the Website.

7.3 Indicative delivery timeframes are set out in the Shipping Policy.

7.4 Chilli Pool cannot guarantee delivery within stated timeframes. Timeframes may change due to unforeseen circumstances. Except where required by law, Chilli Pool is not liable for any loss arising from delays in delivery.

7.5 Delivery will be made to the address specified at the time of ordering.

7.6 If delivery cannot be completed due to access restrictions, size of order, or unsafe conditions, a notification will be left advising where goods may be collected.

7.7 If goods are not collected within the required timeframe following a failed delivery, contact our customer service team. Redelivery fees may apply.

7.8 On receipt, inspect your goods immediately. If there is visible transit damage, contact us as soon as practicable.

7.9 Any person accepting delivery on your behalf is deemed to be authorised by you to do so.

8. Risk and Title

Risk and title in the goods passes to you upon delivery of the goods to the delivery agent.

9. Order Cancellations and Returns

Unless otherwise provided in these Terms and Conditions, no cancellations or changes to orders will be accepted once submitted. Check your order carefully before submitting. Faulty or incorrectly delivered goods may be returned in accordance with our Returns Policy.

10. Promotions and Discounts

Chilli Pool offers and promotions apply only to purchases made through the Website. They do not apply to purchases made through partner websites or other retail outlets.

14.1 These Terms and Conditions are governed by the laws of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and any courts with jurisdiction to hear appeals from those courts.

14.2 The Website may be accessed from outside Australia. Chilli Pool makes no representations that the Website complies with the laws of any country outside Australia. If you access the Website from outside Australia, you do so at your own risk.

14.3 Chilli Pool reserves the right to update these Terms and Conditions at any time. Changes take effect on posting to the Website. The Terms and Conditions in place at the time of your order govern that transaction.
